REFUND POLICY
SparksLife Worldwide OÜ
This Refund Policy has been developed to reduce financial and legal risks of SparksLife Worldwide OÜ, observe principles of anti-money laundering and counter terrorist financing policy. When we use “We”, “Us”, “Our”, “Sparks Life” in the text of this Policy we mean SparksLife Worldwide OÜ, a company registered in Estonia at Tuukri 19-315, Tallinn, Estonia, registration number 14549959, which is the developer and the owner of the products and services offered in the Sparks Life’s official application, located at App Store and Play Market (the “Application”).
Payments for yacht tours and rental of yachts are non-refundable. Prior to making a transaction, you confirm that you are acquainted with and accept our Terms and Conditions of Use and fully understand the Services you are ordering. When transferring funds to Sparks Life, you agree not to lodge a request to the bank to charge the card payment back, which has already been received to our account. Any such attempt will be treated by Sparks Life as a breach of the Terms and Conditions of Use, for which you may be subjected to responsibility in accordance with Estonians’ legislation.
If we classify your activities as inappropriate or contradicting the usual purpose of our Services usage, where there is a direct, or indirect, illegal or dishonest intent, we have the right to act within the framework of this document and applicable laws, without informing you in advance.
Payments for yacht tours and rental of yachts cannot be refunded unless:
1.Yacht tour is cancelled or yacht that is to be rented is not available. If yacht tour is cancelled or yacht that is to be rented is not available after the payment is done, we will contact you as soon as possible by email using the details you have supplied. We cannot be held liable if you do not receive this notification because you have supplied us with an incorrect email address or because you have failed to update the email address that we hold for you. We also cannot be held liable should your email filter settings block or divert our emails to your spam or junk folder.
2.If we cancel the yacht tour or cannot provide a preselected yacht you will normally be offered a refund.
3.If our yacht tour is rescheduled, we will usually give you the option of retaining your booking for the rescheduled yacht tour (new date) or alternatively moving the value of the purchased yacht tour to the other available yacht tour.
4. If the Client rejects the yacht tour more than 2 weeks before the tour starts, he will normally be offered a refund. If the yacht tour starts in less than 2 weeks, you will not be entitled to a refund.
5.If for reasons of Pandemic, Force Majeure, (including but not limited to an act of God, war, strike or fire) the yacht tour or rental of yacht cannot take place as agreed we reserve the right to reschedule the yacht tour to a date of our choosing and postpone rental of yacht.
If for any reason you are entitled to a refund, you must notify us via email. If you do not notify us that you wish to obtain a refund, or you do not notify us within the times set out in this Policy, you will be deemed to have chosen to retain services, for which payment was made, and you will not be entitled to a refund.
Payments for yacht tours and rental of yachts cannot be refunded other than for the reasons set out in these Refund Policy. No refunds will be offered under any circumstances if you fail to comply with these Refund Policy.
No refunds are allowed, but if you have made a mistake while performing the payment, you must contact us shortly but not later than 2 business days after performing the payment, otherwise we will not be able to assist you.
The inability to attend a yacht tour or making an error when performing the payment (for having incorrectly entered the email or other data in the payment process, for example) are not reasons that allow the refund. However, you can always contact us through the means indicated in these Terms.
We expect you to resolve refund issues first by contacting us before contacting banks or financial institutions with a chargeback request. The procedure shall be the follows:
1.You need to write to our support email company@a-sparks.com a motivated request for a refund marking in the subject line “Refund” and name indicated while performing the payment. You will be given to fill out our refund form.
2.When filled by you refund form is received by us, we will respond to you within 15 business days and may request additional documentation, if necessary, to verify and process the refund.
3.You are obliged to respond no later than 14 calendar days to a letter from us from the moment of its receipt.
4.Refunds, subject to our approval, will be processed within 14 business days from the date you were notified of our positive decision to refund.
In the event that you initiated a payment return (chargeback) procedure at your bank or financial institution, we will consider such a chargeback request and inform the bank or your financial institution whether such a transaction was canceled.
We have the right, under certain objective reasons and, if it is necessary on its discretion, to make a refund of funds via bank transfer. Furthermore, the refund will be made to the bank details, which have been used by you when paying us the funds for our Services.
In the event that the payment is returned, it will be reimbursed to you in the same means of payment used for making the payment.
All direct or indirect losses, expenses connected with transfer of funds are reimbursed to Sparks Life from your funds and may be affected by the applicable currency price volatility.
MISCELLANEOUS
This Refund Policy comes into force on May 1, 2023.
